Canadian Work Visa Permit Programs
With or without a Labor Market Impact Assessment (LMIA), the Canadian Work Permit Visa allows eligible professionals, such as business people/permanent and transient employees, to work in Canada with a valid job offer. However, in some instances, employment proposals are not required when applying for a Canadian work permit.
Applicants interested in obtaining a Canadian work permit have two options, depending on their requirements and occupation:
1# Employer-Specific Work Permit for Canada:
This type of work permit permits foreign professionals to work for a single employer who has offered the position. In addition, the employees will be restricted to the conditions outlined on the Employer-specific work permit, such as the employer they can work for, duration, and location.
Alternatively, when applying for an Employer-Specific Work Permit, the employer must have provided you with a copy of the employment contract and an LMIA containing the employment offer number.
2# Canada Open Work Permit Application Process:
The second variety is the Open Work Permit without a specified occupation. Foreign applicants for an open work permit in Canada are not required to have a job offer from a Canadian employer. Similarly, a copy of the LMIA or an employment offer number is not required for this form of permit.
Eligibility Requirements for Canadian Work Visa Permit
Before applying for any type of Work Permit, the applicant must comply with the following conditions:
- The applicant will depart Canada upon the expiration of the work permit.
- The applicant poses no threat to Canada’s security and has no criminal history.
- The applicant has sufficient funds to support himself and his family during their stay in Canada.
- The applicant is in excellent health and will submit to a medical examination when necessary.
- Except for the listed employer, the applicant will not work for any other ineligible employer.
Application Procedure for Canadian Work Visa Permit
The application procedure for a Canadian Work permit varies depending on the type of permit being sought. In general, it is a two-step procedure, with a few cases requiring a Labor Market Impact Analysis. Prior to hiring any international professional for a particular position, the employer must obtain the LMIA through Employment and Social Development Canada (ESDC).
For an Employer-Specific Work Permit, ESDC will first provide the LMIA to the employer. Once a positive LMIA has been granted, the employee must register for a work permit with the required documents and a CAD 155 per person application fee.
To register for an Open Work Permit, however, you only need to select the type of work permit on the application form. Pay all work permit application fees, including the CAD$155 Open work permit fee and the CAD$100 Open work permit holder fee. Then, submit a complete application as a worker, sponsored spouse, or common-law partner who is already residing in Canada.
